Definitions used in this NTD policy

You or Notifier: the person or company, organization or other entity that files a Notice.

We, us or Medal: Medal B.V.

Content Provider: the person or company that has placed (alleged) unlawful content on the Platform.

Platform: our online platform that enables users to record and share gaming clips and videos, accessible through our applications and website: medal.tv.

Notice: the notice you provided us in accordance with this NTD policy.

When should you submit a takedown request?

If you believe that content on our platform is unlawful or contains statements that are defamatory to you or that infringe your intellectual property rights, you should always first get in touch with the person or company that placed the content on our platform (the "Content Provider").

However, in some situations you might not be able to reach an agreement with the Content Provider or fail to receive a response. For this purpose we operate this notice and takedown procedure enabling you to notify and request us to take measures.

Be aware of the implications

It's important to point out that submitting a takedown request will start a legal process. Therefore, before you submit a report, you should be certain and be aware that:

  1. statements that are true or reflect an honest opinion usually do not constitute defamation;
  2. regarding intellectual property rights legal exceptions and limitations can apply which may render your takedown request invalid;
  3. submitting a false claim may expose you to liability against Medal and/or third parties;
  4. abuse of this notice and take down procedure, such as but not limited to the intentionally submitting misleading or otherwise false notices and/or submitting a request for take down regarding content to which you are not the rightsholder, may lead Medal to taking action against you, including termination of your account (if applicable); and
  5. you indemnify us against all claims from the Content Provider and any other third parties related to measures taken pursuant or connected to your Notice. You declare that any Notice and accompanying or related statement(s) you submit may be used in court proceedings.
  6. any personal data you provide to us will be used in accordance with our Privacy Policy.

You should therefore carefully consider all facts before you submit a takedown request (and acquire legal advice).

Filing a notice

Filing a Notice is easy. You can use the template NTD letters that are included below (the "NTD Template(s)") and submit your request to [email protected]. Please note that there are two versions: one relates to defamatory or unlawful content and the other relates to intellectual property infringement.

Notice requirements

All questions and/or requested information prompted in the NTD Form or included in the relevant NTD Template should be answered truthfully and completely.

We need to receive sufficient information to act upon. This means that:

  1. we do not process any Notice that lacks necessary information;
  2. if a NTD report is submitted by email but does not adhere to the relevant NTD Template, we cannot process your NTD report; and
  3. we reserve the right to ask for verification of your identity, authorisation and to seek further information from you to clarify the basis of your claim. If you are acting on behalf of the claimant, you must be authorised to do so and state your relationship to the claimant.

Processing and assessment of the Notice by Medal

After receipt of a Notice we will assess whether the content concerned is unequivocally unlawful and take measures in accordance with the section below titled 'Measures'.

Medal will use reasonable efforts to identify unlawful content when notified but cannot be responsible if you have failed to provide all the relevant facts or where these facts cannot be ascertained.

Medal processes Notices in the order in which they are received, except if the provided reasons of urgency would determine otherwise. Once you've submitted a Notice, we will email you confirmation of your Notice. If you do not receive a confirmation of your Notice, that means we did not receive your complaint and you should re-submit your Notice. However, please note that submitting duplicate Notices will result in a delay in processing.

If you request Medal to deal with the Notice as a matter of urgency, you must explain the reasons for such urgency. Medal will decide at its discretion whether the report should be dealt with as a matter of urgency.

Measures

If Medal determines that the content concerned is not unequivocally unlawful, Medal will inform you accordingly, stating the reasons.

If Medal determines that content concerned is equivocally unlawful, we will ensure that the content is (at our sole discretion) promptly:

  • Removed;
  • restricted/made inaccessible; and/or
  • other technical measures are taken.
